TERMS OF SERVICE
Before starting a commission, both the artist and the client need to make sure they are on the same page to avoid misunderstandings, so please take some time to read through these terms! They will be displayed on my website, but also linked in my commission form and paypal invoice.
By commissioning the artist, the client agrees to the following terms:
I. Engagement
• Client must provide clear and complete reference / assets useful to the commission and/or a clear explanation of what the commission entails before work begins. Any late minute addition may be charged.• If the client can’t provide clear visual reference for the commission, a fee may be added to the final price. Please see this link to know more about the design fees. Depending on the details provided, a pinterest moodboard can potentially lead to a design fee, this will be mostly case by case.•Please note that anything along the lines of "have fun with the design" / "i was thinking you could tweak the design a little bit", etc... will count as design work.• I reserve the right to refuse projects or requests based on content, subject, or any other reasons.• Client has to be aware that I have a specific artstyle and will not change it to make it look like someone else’s artstyle.• Client is allowed to change their request as long as the work has not started. Upgrading (example : changing from a 10€ commission to a 20€ one) is allowed, but not the other way around.• No refunds are possible after work begins unless initiated by me.
II. Content restrictions
• I will not create content that is offensive or inappropriate. Explicit artworks have to be discussed with the client beforehand.• I will not create the following : Hardcore adult content, NSFW involving underage characters, excessive muscles, gore, mimicking someone else's artstyle, heavy mecha, furry.• I am okay with : Softcore adult content (lingerie, soft nudity, mild intercourse scene… Please discuss the subject privately for more informations)• About character designs : I will happily create feminine character designs for the client, however masculine ones will need a discussion beforehand (case by case).• About 2D Vtuber models : I will happily create feminine Vtuber models for the client, however masculine ones will need a discussion beforehand (case by case).
III. Timeline and process
• Work completion may take up to :
- 3 months for standard projects (Headshots, Fullbodies, Chibis, etc)
- 5 months for bigger projects (Full illustrations, Vtuber models, possibly rendered artworks)
Timeline will heavily depend on different factors like complexity, commission types and workload. That’s why the client should plan launches and streams accordingly.• If there are any delays due to personal circumstances, I will add a note on my Trello to inform clients.• I will provide a first draft sketch and seek the client’s feedback before proceeding further. No major change will be accepted after the client has given their approbation for this step. (Please note that the sketch commissions will be done in one go, similarly to skeb commissions, and a draft sketch will not be provided in most cases)• I may provide an update after every big step completion (lineart, flat colors, shading, etc…) if the client specifically asks for it.• Final deliverables are provided using mainly e-mails or Drive. If the files are too heavy for the e-mail, the product will be delivered using Google Drive. If the client ordered through the Vgen platform, the final product will be delivered there. Please note that e-mail days are usually on wednesdays and sundays.• The delivery e-mail will include : the final product in .png, a legal business invoice in French. I may also provide a watermarked .jpeg version of the commission if the client specifically asks for it.• I may complete commissions in a different order than the order I received the commissions. Inspiration is unpredictable and I value creativity and quality over speed of execution.• My workload and commission progress is publicly available for clients to see and track here.
IV. Revisions
• After linework has started, only minor changes (small color adjustment, one layer detail…) will be allowed. Major ones (position, removing or adding an element, several layers details) will be charged from 5€ up to 15 € depending on the case.• Additional charges (more than the 15€ stated above) for excessive revisions may be required.• If the client has any specific request (for example: a specific pose); please state it beforehand. Asking for a whole pose change after the sketch has been worked on will sadly fall into "excessive revisions" and charged a fee, as indicated above. This applies to anything that require restarting the work from scratch due to a lack of clear communication on the client's part.• I will take responsibility and make free revisions if I unvoluntarily forget a detail previously specified, make a color mistake, or any mistake entirely due to my negligence.• Revisions may affect progress and timeline.
V. Communication
• Communication about the overall work will occur during the commission process, through DMs with the client. As twitter DMs are now limited, I will usually ask for another way of contacting the client : Discord, Instagram or e-mail, through the commission form. This will be used only if I fall into DM limitation.• My response time may vary, in order to provide better updates. I may not reply if it's week-end as I do not necessarily work on those days.• Please refrain from spamming and talking about unrelated subjects to get a faster reply, please keep the conversation mostly about the artwork if possible.• Please keep in mind that I have most likely several commissions going on at the same time. If the client didn’t get any update in the last two weeks, it’s probably very normal, as art is my full-time job, and I also have to manage my disabilities everyday.• Please read through these terms again if you have any question that can be answered here, as the artist took time to write everything clearly to avoid miscommunication.
VI. Rights and usage
• Artist rights :
The artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing the work and work in progress on websites, social medias, portfolios, public broadcast channels and more.The artist may use the client’s commission for printing and copy purposes if the character involved is not yours. (ex. Kokomi from Genshin impact headshot can be used and printed as a keychain or pin button by the artist )• Client rights :
Clients receive exclusive, non-transferable usage rights to the work for personal use. Refer to the next section for commercial rights.Personal use means : display on social media accounts for promotional purposes with no direct monetization, such as profile pictures, banners, and posts; print and framing in personal spaces…Client must not claim the artist’s work as their own and must credit the artist using their social tag/username/link at the instance of display of the work or permanently on their websites, social media profiles, broadcast channels and so on.Client must nor edit or modify the artwork in any way without prior permission from the artist.
VI.2 Commercial usage
• Commercial usage rights are not included unless specified in the commission type or listing on the artist’s website ( ex. Vtuber model, Pngtuber model, emotes, etc…) or as agreed upon.• Commercial usage means usage of work on streams, videos and other content, or any monetized instances, or selling or reselling work to another party, as a part of any product, or on another platform.• Usage of work for AI tools, platforms or programs, NFT, blockchain, or other for profit platforms/purposes, is strictly prohibited.• Additional charges will be required for commercial usage if not included. VII. Payment& Fees
• All payments will be made in € (EURO).• Client is required to pay prior to the start of the commission. No work will be started before it’s been paid, unless a payment plan has been agreed on.• For orders above 150€, payment plans are available. I am open to discussion on this matter.• A paypal invoice will be sent to the client. Clients must not send money before I request payment from them, unless it's for a donation purpose.• I mainly use paypal but is completely open for other payment suggestions such as stripe, wise, etc.• Invoices must be paid within 5 days (unless agreed otherwise/ on a set date), or the project may be cancelled. Once a project is cancelled, the client may not be allowed to contact me again as this would be what we call a timewaster.• Paypal fees are built in the price, as well as taxes.• Prices might be displayed different on carrd and Vgen because of the different fees occurring on each.• Once work has begun and payment have been made, the client acknowledge the final product is digital and there will be no physically shipped goods to receive, unless the client requested a traditional artwork.• Depending on the complexity of the commission, the final price may vary. Things such as extreme hair length, extremely detailed outfit, armors, lack of clear reference may increase the final price. The price ranges are displayed in the commission prices page.• If the client has a deadline shorter than 1 month, there will be a rush fee from 45 to 100€ depending on the my current workload and the commission complexity. (The shorter the deadline, the higher the fee)• I may ask for a 30% deposit if the client would like to join my commission waitlists when commissions are closed. This is to avoid ghosting and fruitless communication.
VIII. Confidentiality
• Client must be aware that infos required in the commission form such as legal name or country, are needed in order to provide legal business invoices. Failing to be able to provide legal business invoices as a proof that they're earning money legally could send me to jail.• If the client is not comfortable providing these informations, requesting a commission through Vgen is the only alternative at the moment. Please note that this alternative does cost a higher price due to the website's fees.• Please specify if the art must remain private for marketing reasons.
